Opposite Worlds - Sharing Sentiment Rules and Procedures
These Sharing Sentiment Rules and Procedures are subject to change at any time at the sole discretion of Syfy Media Productions LLC and NBCUniversal Media, LLC (collectively, the “Producer”). Void where prohibited.
Syfy’s Opposite Worlds (the “Show”) is unique in that YOU can influence the game. By Tweeting about the players on the Show via Twitter (each, a “Sentiment”), you can influence the players’ popularity and help determine the most popular player and the least popular player on the Show. Players’ popularity is determined by using your Sentiment in the Producer’s algorithm to calculate a popularity score for each player. Each week, the Show’s most popular player and least popular player will be given rewards and punishments that can help (or hurt) their gameplay.
Tweeting a Sentiment (“Sharing Sentiment”) is simple and easy. To submit your Sentiment, log onto your personal Twitter account and Tweet a player’s name, the hashtag “#OppositeWorlds”, and how you feel about the player. Sharing Sentiment will be conducted pursuant to these Sharing Sentiment Rules and Procedures and any such other rules and procedures as Producer may from time to time designate.
Eligibility: You must be a permanent legal resident of the United States, the District of Columbia, or Canada with a valid Twitter account. Visit Twitter.com to register for an account. To Share Sentiment, you must have your Twitter account set to public. Sharing Sentiment is free with a valid Twitter account. Data rates may apply. Sentiments must be cast by the authorized account holder of the Twitter account from which the Sentiment is made.
Sharing Sentiment Period and Restrictions: Sharing Sentiment is open throughout the duration of the show between Tuesday, January 21, at 12:00:01 AM ET and Wednesday, February 26, at 11:00:00 PM ET (the “Sharing Sentiment Period”). The popularity results will be announced on-air during the Show and/or on the Producer’s website at oppositeworlds.syfy.com (the “Website”). There is no limit as to how many times a person may Share Sentiment from his or her account, but Producer reserves the right to limit the number of eligible Sentiments in its sole discretion. Notification regarding any such change will be announced on-air and/or posted on the Website. If you attempt to Share Sentiment outside of the defined Sharing Sentiment Period, your Sentiment will not count.
How to Share Sentiment: To Share Sentiment, you must have a valid Twitter account and your privacy setting must be set to public. Log onto your personal Twitter account, and during the valid Sharing Sentiment Period, post a Twitter message (i.e., a Sentiment) discussing how you feel about any of the players using the hashtag “#OppositeWorlds” and the name of a player on the Show. Your Sentiment must include “#OppositeWorlds”, at least one player’s name, and a sentiment about the player for your Sentiment to be valid.
Many misspellings of players’ names will be counted by the algorithm; however, not all misspellings are guaranteed to be counted, so do your best to spell the players’ names correctly. Names are not case-sensitive.
General Conditions: Producer has the right, in its sole discretion, to void any Sentiment that appears, to have been made by a person not meeting the eligibility requirements set forth above, or to be an automated or duplicate Sentiment, and has the right to permanently disqualify any person it believes has violated these rules from Sharing Sentiment. If for any reason the Sharing Sentiment program (the “Sentiment Program”) is not capable of being run or implemented as planned, including, but not limited to, as the result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, or any other cause beyond the control of Producer, which is likely to, or actually corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Sentiment Program, then Producer reserves the right, in its sole discretion, to withdraw the transmission of any Sentiment and/or to terminate or suspend the Sentiment Program at any point. In the event of technical difficulties with the Sentiment Program, including, but not limited to, mobile or Internet service interruptions, Producer reserves the right to review the Sentiments for accuracy and to take any appropriate action, including, without limitation, voiding the Sentiments cast during the time period in which such technical difficulties occurred. Syfy Media Productions LLC, NBCUniversal Media, LLC, and Verizon, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, any other entity involved in the development or administration of the Sentiment Program, and each of their respective directors, officers, employees and assigns (collectively the “Released Parties”) are not responsible for any computer, network, technical, electronic, human or other errors or problems of any kind, for any injury or damage to participants or to any person’s computer or mobile phone relating to or resulting from Sharing Sentiment or downloading materials or software in connection with the Sentiment Program, or for Sentiments that are stolen, misdirected, garbled, delayed, lost, or late. By participating, each individual agrees to release and hold the Released Parties harmless against any and all claims and liability of any kind arising in whole or in part, directly or indirectly, out of their participation in the Sentiment Program.
Caution: Any attempt by you or any other individual to deliberately damage any online service, mobile phone service, or website, tamper with the Sharing Sentiment process, or otherwise undermine the legitimate operation of the Sentiment Program is a violation of criminal and civil laws and should such an attempt be made, Released Parties reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.
Disputes: THESE RULES, AND SUBMISSION OF YOUR SENTIMENTS, ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
